Estate Planning for Special Needs Children & Adults

When a loved one has a disability, providing for that person is of the utmost importance and should be a paramount goal in your estate planning.
 
A purpose of creating a Special Needs Trust, commonly referred to as a SNT is to make sure that your child or loved one receives the needed public benefits such as Supplemental Security Income (SSI) and Medicaid.
 
Special Needs Trusts are also used to ensure that your loved ones are adequately cared for in the event of their primary caregiver’s death or incapacity.
 
There are two main types of Special Needs Trusts:

     ► First Party Special Needs Trusts

A First Party Special Needs Trust is a type of SNT where the source of funds being placed within the trust are from the disabled person him or herself.

     ► Third Party Special Needs Trusts

A Third Party Special Needs Trust is a type of SNT where the source of the funds being placed within the trust is from a friend or family member and not the disabled person.

Kane has served as Special Magistrate for the Eleventh Judicial Circuit Court in and for Miami-Dade County and has served as Court Appointed Receiver for the Eleventh Judicial Circuit Court in and for Miami-Dade County. Mr. Kane frequently lectures on the topics of probate administration and estate planning.
